POSITION SUMMARY:

• Provide oversight regarding compliance with tax rules related to information reporting, payroll, wealth management consulting, certain fringe benefits and executive compensation for TIAA. Develop new tax positions for information reporting and payroll issues and review/approve technical positions presented by in-house lawyers and outside tax professionals. Track new tax law for information reporting and coordinate with Tax Operations for compliance with new rules or application of existing rules to new products or distribution scenarios. Provide oversight and technical expertise in adoption of new or enhanced processes and policies to Payroll and Tax Operations as tax law and regulatory changes occur.

• Assist with product tax related compliance and product design, Assist with company tax matters.

• Provide tax oversight for TIAA Charitable.

KEY RESPONSIBILITIES AND DUTIES:

  • Manage a team (currently 2) of tax attorneys and interact with a significant number of business partners and the individuals responsible for tax matters and assist them with achieving and maintaining compliance with a multitude of federal, state and international tax matters

  • Interact with Advocacy & Oversight (A&O)

  • Participate in tax remediations, process changes and identify and drive solutions for future compliance.

  • Lead research efforts on various research projects that can involve corporate, withholding or product tax related issues.

  • Monitor new legislation and technical guidance and assist business partners to implement the new rules on a timely basis.

  • Requires significant analytical abilities as the usual complexities of tax issues are multiplied by TIAA and CREFs uniqueness and the various business lines of TIAA.

  • Requires ability to understand complex insurance, asset management and banking products and related distribution arrangements and apply tax rulings.

  • Reviews processes and controls and suggests improvements. Assists CSG in resolving participant complaints and identifying trends requiring additional review and investigation.

  • Coordinates discussions with outside counsel or consultants, when appropriate.

  • Facilitates compliance planning for major new information reporting rules (i.e. FATCA) to ensure tax compliance is implemented and automated, when possible.

  • Partners with the Tax Audit Director and applicable business partner to consider appropriate remediation’s of tax compliance issues.

Qualifications:

QUALIFICATIONS:

Required Skills, Degrees, Certifications and/or Licenses:

  • BS/BA degree required

  • JD required

  • 7 years of insurance or pension information reporting compliance experience combined with 10 to 15 years overall experience managing general business tax issues for large corporations.

  • Exposure to insurance and pension products

  • Tax product remediation and closing agreements, internal controls and process development; broad exposure to payroll taxes, fringe benefits, executive compensation, multi-state payroll taxes and FATCA

  • This role requires constant interaction with teams and leaders across the entire company, as well as outside consultants and regulators and ability to drive consensus on tax aspects of business projects.

  • An understanding of insurance and pension industry business and compliance practices is required to give practical advice.

  • Licensed Attorney and Admission to State Bar

Desired Skills, Degrees, Certifications and/or Licenses:

  • LLM in Taxation

  • Banking or securities industry experience is a plus.

  • Skills and Abilities: Legal and analytical skills, tax research ability, communication, project management, driver of change. Interpersonal skills are essential as this role requires constant interaction with teams and leaders across the entire company, as well as outside consultants and regulators and ability to drive consensus on tax aspects of business projects. Expertise in taxation of qualified products, employment tax and withholding and information reporting is required to serve as SME, together with the ability to readily assimilate through study and practice, the principles of any other field of taxation.

  • In addition to required experience, ERISA and company tax experience, banking and securities industry experience
